RULES and REGULATIONS FOR SUPERVISED VISITATION/EXCHANGE
California Law- Standard 5.20 defines the standards of practice for all providers of supervised visitation within the state of California, under Family Code section 3200.
My mission is to provide an opportunity for families in transition to obtain reliable support during their change process to ensure success for parents and children alike.
I provide these services to the CP, NCP, as well as other legal parties without discrimination, bias, or prejudice.
My primary responsibility is to provide a neutral, safe, stress-free, and child-friendly environment for children to be able to continue with, reunite in, and initiate a family relationship with the NCP.
The mental and emotional health of children is the most crucial aspect of my work. Consistency and routine are vitally important for children who are experiencing significant changes in their family lives.
While always necessary, the Child's need for a sense of dependability and predictability is significantly increased during family transitions, so these policies are designed to support and encourage consistency and routine for the Child.
SUPERVISED VISITATION OR EXCHANGE
Supervised visitation/exchange time includes comprehensive observation of the entire period of contact between the CP, NCP, and the child/ ren. Observation and documentation of verbal and non-verbal behavior is the task of the monitor. Exchange times and locations will be discussed and agreed on.
RESPONSIBILITIES
For the sake of the children, you are expected as adult parties to work toward an acceptance of the co-parenting relationship and to develop a spirit and spark of cooperation and respect. I will support any activity that demonstrates a commitment to co-parenting and will stop any activity that denigrates co-parenting. As a monitor, I am mandated to report child abuse to the appropriate authorities as provided by law (1-800-540-4000) and severe threats to harm others. I will notify relevant authorities if any suspicion is present. I am required to report all violations of Restraining Orders to the Court when witnessed.
As a monitor, I will not speak to the adults about any aspect of the case/situation in front of the child/ren. PLEASE DO NOT ATTEMPT TO DO SO. If there are any concerns regarding your visitation/exchange or monitoring, they must be discussed later, and your concerns must be in writing.
As a monitor, I will not act as a go-between on any adult matter not pertinent to my role as your professional supervisor, which includes legal and financial business. Please do not send emails or discuss any issues that are not related to scheduling a visit or a visit itself. No confidential privilege exists. I may choose to forward conversations or emails to the opposite party and or attorneys. There will be additional fees if emails or text demand extra time on my behalf. The sending party will pay their fee.
As a monitor, I will transfer child-sensitive information and items like medicine and favorite toys, food, and clothing. The visitation/exchange time with your child is not the time to serve legal papers on either party.
As a monitor, I will confirm the NCP has a child safety seat if one is required. Each party will be responsible for securing their child in the safety seat.
ALL ACTIVITIES DURING SUPERVISED VISITATION/EXCHANGE TIME MUST BE OF A SEE-ALL NATURE AS IT RELATES TO ANY PHYSICAL AND VERBAL CONTACT BETWEEN THE NCP AND THE CHILD/REN. If your child needs to use the restroom and needs assistance, I will assist him or her, or we may use the family restroom.
SUPERVISED PARENTS and VISITING PARTIES MUST KEEP ALL COMMUNICATIONS IN THE HERE AND NOW, WITHOUT REFERENCE TO THE PAST OR THE FUTURE. PLEASE DO NOT WHISPER TO YOUR CHILD/REN.
All parties must abide by the rules and regulations. Visitors breaking the rules will be asked to leave.
Discussions about the PAST, including adult conversation or the FUTURE, will not be allowed and are grounds for the visit/exchange to be suspended or terminated. Please do not talk about future visits with your child/ren. You have full intentions of scheduling the next visit, but it does not happen, it may be a letdown for your child/ren. The supervised parent will comply with these requirements. Please ask for assistance from the monitor should there be any doubt or question about an activity. The visiting time belongs to the NCP and Child/ren. Please choose age-appropriate activities for your child/ren.
As a monitor, I may suspend or terminate a visit/exchange at any time a child either states or appears to be over-stimulated or over-stressed by the amount of time or level of activity. Alternatively, in the case of inappropriate and disallowed comments or actions by the NCP who will not respond to communications by the monitor to stop the inappropriate behavior, the monitor's decision to terminate is not negotiable.
As a supervised visitation monitor, I have the right to require any party to attend orientation on a repeat basis. An additional fee will be applied. As a monitor, I may suspend or terminate a court-ordered visitation/exchange case if I determine that a parent or the parent's identified representative is unable or unwilling to follow established polices.
POLICIES
It is prohibited Alcohol or other drugs within twenty-four (24) hours of the scheduled visit or exchange. Tobacco use in any way is not permitted during a visit or exchange.
A visit will not be allowed if the NCP appears to be physically unable to appropriately participate in the parenting time/transfer at the discretion of the monitor.
Disparaging remarks and intentional disrespect whether communicated verbally or non-verbally toward any adult party, including the monitor, will not be tolerated, and may result in suspension or termination.
If a family and supervisor choose to have a permanent time slot for visitation/exchange and the parties fail to use 50% of the time or fails to use three times in a row, the family may lose their time slot. If an NCP is late, the CP must wait at least 10 minutes. After 10 minutes, the CP may leave if the NCP has not called or fails to show up but maybe encouraged to stay longer if the arrival of the NCP is specific. If the NCP is late, the scheduled time for the visit will extend. Please do not expect the monitor to remain past the scheduled time; it is the decision of the supervisor whether to wait or not. If you are arriving, late contacting the monitor is for the peace of mind of the child/ren waiting. The CP arriving with children must arrive 5 minutes before the actual visit/exchange time. The CP arriving at the end of the visit must arrive 5 minutes after the visitation hour or if the supervisor text the CP of the NCP's departure. If a restraining order is a court order, the parties must stay 100 yards away or court-ordered distance. NCP is to arrive on the hour or half-hour. Please do not approach the pickup area until the CP or NCP has left. If the exchange is a peaceful exchange, all parties are to arrive at the visitation time but are to ask to remain in your vehicle until the supervisor arrives. Each parent and monitor will discuss locations. Please keep in mind what is best for the child/ren. Please remember the supervisor will be responsible for your child/ren during the exchange times, so please be on time.
As a monitor, if I am not available for the day or times requested, an alternative day will be chosen, or I may ask another professional/non-professional supervised visitation monitor to substitute for me that is affiliated with A New Day. Having a make-up day or substitute in my absence ensures a visit between the NCP and Child/ren. If it is a court ordered exchange only, I will do my best to maintain a professional or non-professional to monitor the exchange.
The visits will occur at a chosen place. They will include only the NCP allowed by the Court, and no others unless the professional supervised visitation monitor agrees to other parties attending. A court order is required to over-ride these requirements or written agreement of all legal parties to the case. Following the fifth visit, guests may be allowed to join the visit with the child/ren and NCP; the professional supervised visitation monitor must approve this in advance. Guests must read the rules and guidelines of the visitation. Advance notice must be given to the supervisor if requesting a guest to join the visit with the child/ren. A court order must state if a specific guest or location of visitation is prohibited.
Photography and outside activities are allowed on all visits unless prohibited by the court order. Gifts, cards, and cash are permitted.
A copy of the court order, mediation report, and any restraining order must be given to the monitor to move forward with visitation. If a prior professional supervisor has been involved, please provide their court report if one has been issued.
The NCP or the person transporting will provide a copy of their driver's license and car insurance to the monitor.
The CP/NCP will provide the rules and regulations to any parties transporting the child/ren. That person must read the rules and regulations.
The CP may be asked by the monitor to bring the child/ren to orientation. The monitor will use her discretion as to what is brought forth in front of the child/ren.
Additional regulations may apply concerning an exchange service. The discussion will take place at the intake/orientation. Deemed by court order or section 26.2 in sexual abuse/abduction cases, other rules will apply.
The CP is to prepare the child/ren appropriately for the first visit or exchange regarding clothing, toys, and food. SICK children are to be brought to the visit for visitation/exchange unless a pediatrician writes a note explicitly prohibiting the Child from traveling in a car if the child/ren is contagious, hospitalized. If both parents agree to cancel the visit, this will be addressed, but hourly fees apply.
From the second visit on, the NCP shall provide clothing food, toys, and games appropriate to the age and interests of the child/ren, as well as the time of the activity unless prior arrangements are discussed with the supervisor.
The CP will provide information on special dietary requirements, medication, and instructions if needed. Please present on the letterhead of the Child's physician who has set established medical necessity. The CP will provide a schedule to the NCP of nap times, foods, and drinks the Child is accustom to. Please forward a copy of the schedule to the monitor.
